These Terms of Service govern your use of carboncourt.com and purchases from Carbon Court, operated by DTC House. By accessing the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.
1. Online store terms
You must be legally capable of entering a binding agreement in your jurisdiction. You may not use the website or our products for unlawful purposes, interfere with the website, introduce malicious code, or attempt unauthorized access.
2. Product information
We aim to describe and display products accurately. Screen settings, photography, and manufacturing tolerances may cause minor differences in color, texture, weight, or appearance. Product specifications, availability, bundles, and packaging may change when reasonably necessary, provided the product remains materially consistent with the description confirmed at purchase.
Statements about materials, performance, or approval apply only when expressly stated on the relevant product page. Nothing on the website should be interpreted as a certification by a sports governing body unless the certification is specifically identified and verifiable.
3. Prices and promotions
Prices are shown in the currency displayed at checkout. We may change prices or end a promotion before an order is placed. Limited-time and bundle offers are subject to availability and the specific contents and options shown on the product page at checkout. A price or promotion confirmed in an accepted order will be honored unless there is an obvious error.
4. Orders
Submitting an order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons including product unavailability, suspected fraud, payment failure, pricing error, address problems, or limits on promotional quantities. If we cancel an order after payment, the affected amount will be refunded to the original payment method.
You agree to provide current and accurate billing, delivery, and contact information. Contact us promptly if an order detail is incorrect. Changes or cancellation cannot be guaranteed after processing or fulfillment begins.
5. Payment
Payment is processed through the payment methods shown at checkout. You authorize us and our payment providers to charge the total displayed when you submit the order. Additional bank or currency-conversion fees charged by your provider are your responsibility.
6. Shipping and delivery
Processing, delivery estimates, tracking, delays, and address responsibilities are described in our Shipping Policy. Delivery dates are estimates and may be affected by carriers or events outside our reasonable control.
7. Returns and refunds
Return eligibility, return shipping responsibilities, the return location, and refund timing are described in our Returns & Refunds Policy. You must contact us and receive authorization before sending a return.
8. No separate product warranty
Carbon Court does not currently provide a separate commercial or manufacturer warranty. This does not exclude rights that cannot legally be excluded under applicable consumer law. Verified items that arrive damaged, defective, or incorrect are handled under our Returns & Refunds Policy.
9. Product use and safety
Pickleball and other sports involve physical activity and risk. Use products only for their intended purpose, inspect equipment before use, stop using damaged equipment, follow applicable facility rules, and ensure children are appropriately supervised. Consult a qualified professional before participating if you have health or safety concerns.
10. Intellectual property
The website content, brand elements, product photographs, graphics, text, and layout are owned by or licensed to Carbon Court or DTC House and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, sell, or exploit them without prior written permission, except for personal non-commercial use permitted by law.
11. Reviews and user content
If you submit a review, photograph, video, or other content, you confirm that it is accurate, based on your genuine experience, does not infringe another person's rights, and is not unlawful or misleading. You grant us a non-exclusive right to display that content in connection with Carbon Court. We may moderate content that violates these requirements.
12. Third-party services and links
The website may use or link to third-party services such as Shopify, payment processors, carriers, analytics providers, and social platforms. Their services may be governed by separate terms and privacy practices. We are not responsible for third-party websites that we do not control.
13. Website availability and errors
We may update, suspend, or discontinue parts of the website. We do not promise uninterrupted or error-free access. We may correct typographical errors, inaccurate information, or omissions and may cancel an affected order when reasonably necessary, with a refund of any amount charged for the cancelled item.
14. Disclaimer and limitation of liability
To the extent permitted by law, the website and services are provided on an “as available” basis. DTC House and Carbon Court will not be liable for indirect, incidental, special, or consequential loss arising from use of the website or products. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.
15. Indemnification
To the extent permitted by law, you agree to indemnify DTC House and Carbon Court against third-party claims resulting from your unlawful misuse of the website, infringement of another person's rights, or material breach of these Terms.
16. Severability and waiver
If any provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver of that right.
17. Governing law
These Terms are governed by the laws of Hong Kong Special Administrative Region, without limiting mandatory consumer protections that apply in your place of residence.
18. Changes to these Terms
We may update these Terms by posting a revised version and changing the “Last updated” date. Material changes apply prospectively as required by law.
